Malherek v. City of Fargo

This case is before us upon a certified report of one of the district judges of the-first judicial district in this state. Upon the oral argument, defendant’s counsel moved that the proceeding be dismissed on the ground that the record here does not present a case within the statute, and the rules of this court relating to certification of *1110questions of law to the Suprertie Court. After careful consideration, we have reached the conclusion that the motion should be granted.
