On June 17, 1984, Charles Emil, appellant’s stepfather, was shot and killed.

Appellant, Rodney Lyn Emil (Emil), was eventually arrested and charged with the murder of his stepfather. Following a trial, the jury returned a verdict of guilty of murder in the first degree with use of a deadly weapon. After a June 8, 1988, penalty hearing, the jury determined that Emil should be sentenced to death. This appeal followed.
