On July 16, 1970, William Nowak died from stab wounds inflicted upon him during the perpetration of a robbery at his grocery store in Chester, Pa., on July 9, 1970. Thereafter, on July 21, 1970, defendant, Ernest Frisby, age 14 at the time, was apprehended by the Chester police on a juvenile petition. On August 20, 1970, a hearing was held in the juvenile court whereby defendant was *587certified to the Criminal Division of the Court of Common Pleas of Delaware County for prosecution on the charge of murder.
