The defendant was tried at the February Term, 1903, of .the First Circuit Court, De Bolt, J., presiding, upon an indictment •charging that on August 25, 1902, “and for two weeks next thereto preceding, he, the said Benjamin Hayward Wright, being then and there a clerk employed in the office of the Superintendent of Public Works, a department of the Territory of *125Hawaii known as the Department of Public Works, as chief clerk and clerk of market, and by virtue of his said employment being a public accountant, charged with the duty of collecting and receiving…
