In this canse, Sol Epstein, who was complainant in the lower court, appeals from a decree of the Chancery Court of Shelby County dismissing his bill filed against the appellee, Great American Insurance Company, which company was defendant in the lower court. The defendant, Great American Insurance Company, also appeals, because, although the Chancellor dismissed complainant’s bill, he held that defendant’s agent, Ernest Wilson, by his agreement with complainant, had bound defendant to issue a policy of marine insurance on complainant’s yacht; but that such policy, if and when issued, did not…
