Stuart F. Liss seeks legal and equitable recovery from Vladimir Studeny for legal services performed by Liss in connection with a contingent fee contract. A judge in the Superior Court granted Studeny’s motion for summary judgment on *474the ground that Liss was not entitled to recovery on a contingent fee contract or in quantum meruit where the contingency never occurred. Liss appeals from the judge’s order, and we transferred the case here on our own motion. We now affirm.
