The plaintiff, a resident of Syracuse, and the defendant, a resident of the state of Georgia, by contract executed on the 1st day of March, 1892, agreed to exchange *602lands, that of the plaintiff being situated in the state of Georgia, and that of the defendant being situated in the city of Syracuse. The contract on the part of the defendant was executed by his agent, Edwin E. Blalce, under a power of attorney, the empowering clause of which reads as follows: “ I do make Edwin E.
