Mynatt Leach is under sentence of death for the murder of John D. Heclc. He *586was indicted, tried, and convicted in Anderson County, where the crime was committed. The jury rendered a verdict, finding him “guilty of murder in the first degree, as charged in the indictment, with mitigating circumstances;” but the presiding Judge being of the opinion that no mitigation was disclosed, pronounced the sentence of death.
