I have considered the issues presented in Re Fuller v. City National Bank of Huron, S. D., et al., and have determined them in favor of the plaintiff and against the defendants.

This is an equity suit in behalf of plaintiff, and the facts in the case are practically all admitted, the undisputed evidence diselos*866ing that prior to January 2, 1924, the City National Bank of Huron and the First National Bank of Huron were national banking corporations doing business in said city; that on the 2d day of January, 1924, the board of directors of the former adopted a resolution…
