This case comes before us on a stipulation entered into between counsel for plaintiffs and defendant to try the issue before the court without a jury, as provided for by the Act of April 22,1874, P. L. 109, and the amendment thereto of July 10, 1935, P. L. 640. The parties have also agreéd upon a statement of facts, and therefore, according to this agreed statement of facts, the court makes the following
