Appeal from a judgment of the County Court of Tompkins County (Barrett, J.), rendered March 15, 1991, upon a verdict convicting defendant of the crime of assault in the second degree.

Defendant was indicted for assault in the first degree in *961violation of Penal Law § 120.10 (1) and, following a jury trial, was convicted of the lesser included offense of assault in the second degree in violation of Penal Law § 120.05 (2) for which he was sentenced to six months’ imprisonment and five years’ probation.
