This action is brought on a note for 400 dollars, given by Parish and Tyack,- the defendants below, to John Stevens, the plaintiff, in consideration of a tract of land conveyed by the plaintiff to the defendant. The defence set up was, that the plaintiff had no right to the land conveyed by him, and therefore the consideration of the note failed. It appears by the evidence, that the land was sold for taxes, as the property of William Wilson, by the sheriff of Jjuzerne county, by virtue of a warrant from the commissioners of the said county, bearing date 30th May, 1806.
