In an action to recover damages for wrongful death, etc., the plaintiff appeals from so much of an order of the Supreme Court, Suffolk County (Eerier, J.), dated May 12, 2005, as denied her *694motion for summary judgment on the issue of liability on her cause of action alleging a violation of Labor Law § 240 (1), and granted those branches of the separate cross motions of the defendants and the third-party defendant which were for summary judgment dismissing the cause of action alleging a violation of Labor Law § 240 (1).
Ordered that the order is reversed insofar as appealed from, on the law,…
