This cause is before this court on appeal on questions of law. The action below was one for wrongful death. Plaintiff, in her amended petition, alleges substantially the following: That by appointment of the Probate Court of Lake county she was duly appointed administratrix of the estate of Verne Douglas, deceased, who came to his death on the 28th day of October, 1935; that the appointment was made on the 27th day of November, 1937, and that she is and has been since that date the duly qualified and acting administratrix of the estate; that she commenced this action on the 27th day of…
