T1 Plaintiff filed an application for writ of mandamus based on the trial court's May 20, 2008, amended order dismissing his case with prejudice. The cause was recast as an ap peal from a final order. 1 After review of the record and relevant law, we reverse the trial court's amended order dismissing Plaintiff's case with prejudice and remand to proceed in accordance with the directions set forth in this Opinion.
