MEMORANDUM AND ORDER

COPPLE, District Judge.

Plaintiff Francis E. Simmons has brought this action pursuant to section 205(g) of the Social Security Act, 42 U.S.C. § 405(g), to obtain judicial review of a final decision of the Secretary of Health and Human Services (HHS). The Secretary denied Simmons’ claim for disability insurance benefits on the basis that Simmons was able to engage in gainful activity and was therefore not disabled within the meaning of the Social Security Act.
