The defendant, Jerry G. Ohler, was convicted by a York County District Court jury of a violation of Neb. Rev. Stat. § 28-508(1) (Reissue 1979), possession of burglary tools, a felony, and of a violation of Neb. Rev. Stat. § 28-511(1) (Reissue 1979), possession of stolen property, a misdemeanor. Ohler further was found to be an habitual criminal pursuant to Neb. Rev. Stat. § 29-2221 (Reissue 1979).
