Appeal by the defendant from a judgment of the County Court, Dutchess County (Hayes, J.), rendered July 22, 2009, convicting him of assault in the first degree and criminal possession of a weapon in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

*871The defendant’s contention that the parties’ stipulation was legally insufficient to establish the element of serious physical injury required for a conviction of assault in the first degree is unpreserved for appellate review (see CPL 470.05 [2]), and, in any event, is without merit.
