BAKER, Circuit Judge.
If the attempt of an Indiana citizen and resident, one Henry Long, now deceased, to create by his will a charitable public trust of his property in Indiana, was ineffectual, complainants, citizens of Illinois, are entitled by the Indiana law of descent to his residuary estate, which is now in the hands of defendants.
Long devised his residuary estate to the Union Trust Company of Indianapolis as trustee in fee simple; directed the Trust Company to pay the entire net income to his widow, if she should elect to take that provision in lieu of her legal interest in his estate,…
