Appeal by the defendant, The Manhattan Life Insurance Company of New York, from a judgment of the Supreme Court in favor of the plaintiffs, entered in the office of the clerk of the county •of New York on the 27th day of June, 1900, upon the verdict of a jury rendered by direction of the court, and also from an order entered in said clerk’s office on the 26th day of July, 1900, denying the defendant’s motion for a new trial made upon the minutes.

O’Brien, J.:
The plaintiff Amberg on August 31, 1899, commenced an action and procured an attachment against Blanche Bourbon, and on January fifth obtained judgment against her. The. attachment was levied upon her interest in a policy of insurance issued by the defendant company on the life of her husband, Emanuel Bourbon, which policy became due on May 24, 1899. , The present action is brought: by Amberg, as judgment creditor, and the sheriff, in aid of the attachment levied upon the funds which were due but not actually-paid by the insurance company to Blanche Bourbon.
