I respectfully dissent. This is a very important case in which the MSPB has intervened, and one that should not be lightly considered. The case is important because the majority opinion deprives government employees in the competitive service of certain rights granted to them by Congress in 1978 when it amended Title 5 § 4303 (Chapter 43) governing removal proceedings by an agency against employees for unacceptable performance.
