The plaintiff in error, hereinafter referred to as the defendant, was convicted of having possession of intoxicating liquor with intent to sell, barter, give away, or otherwise furnish to others, and was sentenced to pay a fine of |250 and he imprisoned in the county jail for ninety days, from which judgment the defendant has appealed.

The testimony on behalf of the state, in substance, tends to show that the officers went to the defendant’s home with a search warrant to search his premises and found the defendant at home. A. B. Williams stated he went with Mr. Tittle to defendant’s place;…
