SIMPSON, Circuit Judge:
Johnny F. Blue (Blue) brought suit against the Western' Railway of Alabama (Western) pursuant to the provisions of the Federal Employers’ Liability Act, Title 45, United States Code, Section 51, 1 and the Federal Safety Appliance Act, Title 45, United States Code, Section 11, 2 seeking damages for personal injuries he sustained on June 26, 1970 while serving as a member of a Western switching crew in the Chester Yards at Montgomery, Alabama.
