JOHNSON, Circuit Judge:

Appellants William Allred, Antoine Had-dad, Lou Milhous, Soren Hansen, Donailco, Inc. and six other Donailco owners, officers or employees 1 were charged with conspiring to defraud the United States in violation of 18 U.S.C. § 371. 2 Counts Two through Five charged Allred, Haddad and Donallco with making false or fraudulent statements to an agency of the United States (the Air Force) in connection with contracts for surplus aircraft parts in violation of 18 U.S.C. § 1001. 3 The case was tried before a jury.
