Plaintiff in error was tried and convicted before the mayor of the City of Cochran, upon an accusation charging him with the violation of an ordinance of the city; which ordinance is in the following language: “It shall be unlawful for any person, firm, or corporation to have in possession, custody, or control, within the corporate limits of the City of Cochran, any quantity of intoxicating beverage or beverages, for the purpose of offering same for sale.” From the judgment of the mayor finding the plaintiff in *480error guilty an appeal to the council of the city was taken, and upon the hearing…
