This is an appeal by the defendant from a judgment of the circuit court, entered after trial, which directs that a writ of mandamus issue commanding him, the chief of the police department of the city of Salem, to reinstate the plaintiff as a member of that city’s police department. The plaintiff, who was appointed a police officer of the city of Salem October 2, 1931, was discharged by an order of the defendant September 26, 1938.
