A jury found Brian Atkins guilty of felony murder predicated on aggravated assault and possession of a firearm in connection with the shooting death of Brian Parks.1 On appeal, Atkins contends that the evidence was insufficient to prove that he assaulted Parks with a deadly weapon, that the trial court erred in excluding an unavailable witness’s out-of-court statement, and that the verdict form was misleading.
