On June 24, 1936, plaintiffs filed a petition, alleging that they are owners and occupants of a residence property in the town of Afton; that the said town is the owner of an adjoining property which is used as a public playground and athletic field, equipped with an electric outdoor lighting system; that the town permits various persons to hold athletic contests and games on said property at any time; that the playground is a nuisance; that the persons using said grounds bat, kick, and throw balls on to plaintiffs’ property, knocking down and destroying gardens and plant life, and that they…
