WYCHE, District Judge.

The above action was brought by the plaintiff as administratrix of the estate of Charles A. Hunt, deceased, against the defendant under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51 et seq., to recover damages for actionable negligence of the defendant in causing a derailment of one of its fast passenger trains as it passed a switch at Maple, South Carolina, resulting in the death of plaintiff’s intestate, who was riding thereon as an employee of defendant.
