Defendant-Appellant, Rex W. Cunningham, Jr., pled guilty to an eight-count indictment. Count one of the indictment charged Cunningham with a racketeering conspiracy in violation of 18 U.S.C. § 962(d) (1994). The second count charged a racketeering offense under 18 U.S.C. § 962(c). Counts three and five charged Cunningham with making an extortionate extension of credit in violation of 18 U.S.C. § 892 (1994).
