PER CURIAM:.

After pleading guilty to federal crimes and having been sentenced to 120 months imprisonment, Jon Merritt filed a motion to compel the government to file a Federal Rule of Criminal Procedure 35(b) motion for sentence reduction based on his substantial assistance to the government. The district court denied that motion. Merritt then filed a second motion to compel the government to file a Rule 35(b) motion as well as a motion for an evidentiary hearing on that motion to compel.
