In an action to recover damages for breach of two leases, the defendants appeal from an order of the Supreme Court, Richmond County (McMahon, J.), dated July 17, 2008, which denied the motion of the defendant J.E Turner & Co., LLC, pursuant to CFLR 3211 (a) (1) and (7) to dismiss the complaint insofar as asserted against it.
Ordered that the appeal by the defendants G.L.G. Capital, LLC, Rocco Guidicipietro, and Robert Feters is dismissed, as those defendants are not aggrieved by the order appealed from (see CFLR 5511); and it is further,
