It is undisputed that plaintiff’s husband, while in the employment of the defendant Cream City Sand Company, was fatally injured on November 18, 1927, by being struck by an automobile under such circumstances that plaintiff, on January 6, 1928, commenced a civil action, by the service of a summons on third parties, to recover from them the damages which she sustained by reason of their negligence in colliding with her husband.
