By this proceeding in quo warranto the parties have invoked the original jurisdiction of this court for the purpose of determining who is the Treasurer of the State of Utah. The facts are not in dispute. A. Edsel Christensen was elected State Treasurer in the general election held in 1928. He took the oath of office and filed a bond as required by law and assumed the duties of that office on the first Monday in January of 1929, and from that time to the present has continued to act as State Treasurer.
