This is an appeal from a judgment which declared invalid the appointment of appellant William E. Dyer by the Oswego County Legislature to fill a vacant legislator’s seat therein and the local law pursuant to which Dyer was so appointed, and which declared valid the appointment *188of respondent Raymond Rebeor to the same position by the Governor.
