MEMORANDUM OPINION

FARNAN, District Judge.

Presently before the Court is Defendant Sepracor’s Motion To Dismiss for lack of subject matter jurisdiction. (D.I.8.) For the reasons discussed, the Motion will be denied.

I. PROCEDURAL BACKGROUND

On June 20, 2008 Plaintiffs Dey L.P. and Dey, Inc. (collectively, “Dey”) brought this action, seeking a declaratory judgment that their proposed generic levalbuterol hydrochloride inhalation products, if marketed, would not infringe U.S. Patent No. 6,341,289 (“the '289 patent”), which is owned by Defendant Sepracor.
