On March 4, 1911, B. Rockwell began an action to enjoin the city of Junction City from paving a street in front of his abutting lots and from collecting a special assessment levied upon them. He challenged the sufficiency of the petition upon which the mayor and council of the city had acted, and also the validity of the statute under which the proceedings were taken. Upon a trial judgment was rendered in favor of Rockwell, but while the case was pending in this court upon an appeal taken by the city a settlement was effected between…
