Upon an indictment containing three counts, the defendant was convicted in the Supreme Court of Erie County on September 11, 1941, of the crime of (1) kidnapping a boy sixteen years of age, and of committing upon him while under defendant’s control and detention the crimes of (2) sodomy and (3) assault in the second degree. At the time of the commission of the alleged crimes, defendant was unmarried, thirty-one years of age, and engaged in a radio service business in the city of Buffalo.
