MEMORANDUM ORDER

MAXWELL, Chief Judge.

This civil action was filed on May 7, 1974 by the Plaintiff, United States of America, to recover sums which it claims are due and owing from the Defendant, Eureka Pipeline Company, as a result of twelve violations of Section 1321(b)(3) 1 of the Federal Water Pollution Control Act (FWPCA), as amended 1972, 33 U.S.C. § 1251 et seq., which prohibits “the discharge of oil or hazardous substances into or upon the navigable waters of the United States .
