Indermuehle v. Babbitt

CRANDALL, Presiding Judge.

Keith L. Indermuehle (father) appeals from that portion of the judgment of the trial court which denied his motion to modify seeking primary custody of his daughter and denied him credit on his child support obligation to Dorothy J. Indermuehle Babbitt (mother). We reverse and remand with directions.

The marriage of the parties was dissolved on May 7,1979. Primary custody of Renee Dianne Indermuehle (daughter), who was born on August 11, 1973, was awarded to mother, and father was ordered to pay child support. Mother moved to Florida after the dissolution of marriage.…
