CHATFIELD, District Judge.

The present case is based upon a petition filed by the owner of an ocean-going steam tug, the Patience, asking for a limitation of the liability of the tug, in order to contest that liability. for damages, loss, etc., arising from a collision which occurred on the 7th of May, 1905, at a few minutes after half past 1 in the morning, in the waters to the south and east of the Pollock Rip Shoals lightship, which is stationed about four miles off the coast of Massachusetts, southeast' of Cape Cod, and north of the shallow waters between Nantucket Sound and the Atlantic…
