On December 9, 1992, an accusation was filed in Ware State Court charging Jerome King, appellant, with driving under the influence of alcohol and simple battery. After King’s motion to suppress was denied, he pled nolo contendere to the charge of driving under the influence. King specifically reserved his right to appeal the trial court’s denial of his motion to suppress the results of a breath test. This appeal followed.
