MEMORANDUM OPINION AND SUPPLEMENTAL FINDINGS OF FACT AND CONCLUSIONS OF LAW

ERWIN I. KATZ, Bankruptcy Judge.

This action was originally commenced by the filing of an involuntary petition under Section 303 of the Bankruptcy Code, 11 U.S.C. 303, against Better Care, Ltd., the alleged debtor (Better Care).

On May 27, 1988, this Court entered Findings of Fact and Conclusions of Law (Findings), after trial, finding that the involuntary petition filed in this cause should be dismissed. On July 14, 1988, this Court found, after additional hearings, that the petitioning creditors acted in bad faith in…
