Plaintiff, Continental Mobile Telephone Company, filed a six-count complaint in the circuit court of Cook County seeking a declaratory judgment, injunctive and other relief against defendants, Chicago S M S A Limited Partnership, and its general partner, Ameritech Mobile Phone Service of Chicago, Inc. (hereinafter defendant). The parties had entered into an agreement in which plaintiff purchased cellular telephone services from defendant at wholesale prices and offered those same services to retail customers.
