Statement of the Case.
NICHOLLS, J.
The plaintiff alleged that the defendant was indebted to him in the sum of $15,000, with interest, for this, to wit:
That on September 10, 1907, between the hours of 8 and 8:30 p. m., your petitioner boarded a street car operated by defendant, No. 002 of the Daupliine line, at the corner of Bourbon and Canal streets, in this city, and paid his fare of five cents for the purpose of conveying petitioner to his destination downtown.
