CROSS, Judge.

Plaintiff administratrix appeals from the trial court’s order and judgment sustaining defendants’ motion to dismiss her petition on the ground that it fails to state a cause of action upon which relief can be granted.

The petition is in two counts. Count one contains allegations to the following effect: Plaintiff is the administratrix of the estate of her deceased husband, Oscar Stein, by authority of appointment made by the Orphans’ Court of Philadelphia, Pennsylvania.
