SUMMARY ORDER
Jeremiah Bindrum appeals the district court’s judgment dismissing his complaint sua sponte for lack of subject matter jurisdiction. We assume the parties’ familiarity with the underlying facts, the procedural history, and the issues presented for review.
We review de novo a district court’s sua sponte dismissal of a complaint for lack of subject matter jurisdiction. See Digitel, Inc. v. MCI Worldcom, Inc., 239 F.3d 187, 190 (2d Cir.2001).
