This is an appeal from the action of the circuit court of Jackson county, Missouri, overruling defendant’s motions for new trial and in arrest-of judgment, resulting from the court’s order sustaining plaintiff’s motion to direct the sheriff to collect and distribute the proceeds of a sale under an execution. As the order of the court of which complaint is made was based upon a motion of plaintiff, the record is limited in its scope, but more or less complicated.
