Battey Machinery Company brought an action against Home Indemnity Company seeking to recover upon a payment bond given in connection with a contract between Gann Construction Company and Gordon County for machinery, materials and equipment supplied to Robert D. Warren, d/b/a Rome Plumbing & Heating Company, who was a subcontractor of National Heating & Air Conditioning Company, the latter being a subcontractor of Gann Construction Company.
