WALKER, Chief Justice.

Gulf Production Company held an oil lease on the Trenton Rock acre, a part of the John Douthit survey in Jefferson county, under the Manns and the Nearens, hereinafter referred to jointly as appellees; the royalty interest of the Manns in the oil produced was 15/384, and of the Near-ens 21/384.

On the 5th day of July, 1926, appellees executed a division order to Gulf Pipe Line Company, “guaranteeing” that the Trenton Rock acre was a part of the John Douthit survey and authorizing Gulf Pipe Line Company to receive oil “in purchase” from the wells on the Trenton Rock acre;…
